Adjudicating public interests by private means: the inescapable involvement of states in the Chevron/Ecuador saga

ABSTRACT: Investment arbitration is often presented as an autonomous mechanism to settle disputes between the investor and the host State. Generally the disputes are based in alleged violations of a treaty linking the host State with the State of the nationality of the investor, although sometimes arbitration proceedings deal also with contractual relationships by means of so called umbrella clauses. Differently, the Chevron/Ecuador saga offers – among many other features – other possible uses of investment arbitration. Regarding the situation in the host State, arbitration proceedings are based, on a first stage, on the alleged violation of an investment treaty by means of the judicial proceedings brought by the host State against the investor. More precisely, arbitrations proceedings are brought to block judicial ones. On a second stage, another arbitration is initiated to reverse an arbitration award by means of “official” interpretation of the investment treaty. The comment deals with the salient elements of these saga’s incursions in arbitration.

RÉSUMÉ: L’arbitrage d’investissement est souvent présenté comme un mode à part entière de résolution des conflits entre les investisseurs et l’État d’accueil. Généralement, les affaires qu'il tente de résoudre sont fondées sur la violation de traités liant l’État d’accueil à celui dont l’investisseur est originaire. Dans certaines hypothèses, un arbitrage d’investissement peut en outre découler de la relation contractuelle qui lie ces deux parties à travers le recours à une clause parapluie. La saga entre Chevron et l'Équateur adopte une approche plus singulière et notamment la possibilité de recourir à l'arbitrage d’investissement dans des cas de figure qui diffèrent de ceux énoncés précédemment. En effet, en l'espèce, la procédure arbitrale reposait sur la prétendue violation du traité d’investissement par une procédure judiciaire initiée contre l’investisseur par l’État d’accueil. Plus précisément, la procédure arbitrale avait pour but principal de contrer les poursuites lancées par l’Équateur. Un autre arbitrage avait quant à lui vocation à annuler la sentence arbitrale en se fondant sur une interprétation « officielle » du traité d’investissement. Ce chapitre aborde quelques-uns des éléments les plus importants et controversés de cette saga arbitrale et étudie sa portée en matière d'arbitrage d’investissement.
